Centennial Car & Truck Rentals – Terms and Conditions

1. Introduction

Welcome to Centennial Car & Truck Rentals (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website, centennialrentals.ca (the “Site”), and all related services, including but not limited to vehicle reservations and the submission of credit applications for commercial accounts.

By accessing or using our Site and services, you (“User,” “you,” “your”) agree to be bound by these Terms, as well as our Privacy Policy and Rental Policies & Terms, which are hereby incorporated by reference into this agreement. Please read all documents carefully. If you do not agree with these Terms, you must not use our Site or services.

2. Eligibility and Account Responsibility

To use our services, you must meet the driver requirements outlined in our Rental Policies. You are responsible for maintaining the confidentiality of any account information and passwords and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the reservation and application processes.

3. Commercial Credit Applications

This section applies specifically to commercial customers applying for a credit account with Centennial Car & Truck Rentals.

• 3.1. Authorization and Consent to Information Collection: By submitting a commercial credit application, you, on behalf of your business entity, authorize Centennial Car & Truck Rentals to collect information necessary to assess your creditworthiness. This includes, but is not limited to:
  • Business legal name, operating name, address, and contact information.
  • Business registration numbers (e.g., HST/GST number, incorporation number).
  • Information about company directors, officers, or principals, including personal contact information as provided.
  • Trade references and banking information.
  • Any other financial information deemed necessary for the credit evaluation process.
• 3.2. Consent to Credit Inquiries: You expressly authorize Centennial Car & Truck Rentals or its designated agents to conduct credit inquiries and investigations. This includes:
  • Obtaining commercial credit reports from credit reporting agencies (e.g., Equifax, TransUnion).
  • Contacting the trade and bank references you provide.
  • Obtaining personal credit reports on the business owners, principals, or guarantors named in the application, for the purpose of evaluating the creditworthiness of the business. You warrant that you have obtained all necessary consents from these individuals to provide their information for this purpose.
• 3.3. Use of Information: The information collected will be used exclusively for:
  • Evaluating your credit application.
  • Establishing and managing your commercial account.
  • Processing rental transactions and invoices.
  • Internal risk management and analysis.
  • Undertaking collection activities for any overdue accounts. All information will be handled in accordance with our Privacy Policy.
• 3.4. Accuracy of Information and Ongoing Obligations: You represent and warrant that all information provided in the credit application is true, complete, and accurate. You agree to notify us promptly in writing of any material changes to the information provided. The consent provided in this section remains in effect for the duration of your business relationship with us.

4. Services, Payments, and Charges

All charges related to vehicle rentals are governed by our Rental Policies & Terms. For commercial account holders, payment terms will be specified in a separate credit agreement or as outlined on your invoices. You agree to pay all charges, fees, taxes, and fines incurred in connection with your account promptly. Overdue accounts may be subject to interest charges and collection costs.

5. Intellectual Property

All content on this Site, including text, graphics, logos, images, and software, is the property of Centennial Car & Truck Rentals or its content suppliers and is protected by Canadian and international copyright laws. You may not reproduce, modify, distribute, or display any part of this Site without our prior written consent.

6. Limitation of Liability and Indemnification

• 6.1. Limitation of Liability: To the fullest extent permitted by law, Centennial Car & Truck Rentals shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our Site or services. Our total liability to you for any and all claims shall not exceed the total amount of fees paid by you to us for the specific service giving rise to the claim.
• 6.2. Indemnification: You agree to indemnify, defend, and hold harmless Centennial Car & Truck Rentals, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.

7. GPS Tracking

As stated in our Rental Policies, you acknowledge and agree that our vehicles may be equipped with a Global Positioning System (GPS) tracking device for safety, theft recovery, and compliance with the rental agreement.

8. Governing Law and Jurisdiction

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the Province of Prince Edward Island and the federal laws of Canada applicable therein, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Summerside, Prince Edward Island, for the resolution of any legal matter.

9. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Any changes will take effect immediately upon posting the revised version on our Website. Your continued use of the Site and our services after any such changes constitutes your acceptance of the new Terms. We will update the “Effective Date” at the top of this page to reflect the date of the most recent revisions.
